Information on consideration of appeals in first quarter of 2022

on consideration of appeals from individuals and legal entities received by the Anti-Corruption Agency of the Republic of Uzbekistan in the first quarter of 2022

The Anti-Corruption Agency of the Republic of Uzbekistan is carrying out large-scale work aimed at protecting the rights, freedoms and legitimate interests of individuals and legal entities, establishing a dialogue with the population, as well as bringing the work with appeals to a qualitatively new level.

In particular, in the first quarter of 2022, the Anti-Corruption Agency received a total of 555 appeals, of which 488 were considered, and 67 appeals are currently under consideration. 9 of the appeals considered were resolved positively, 157 appeals were satisfied in the course of legal consultations and clarifications, 18 appeals were declared anonymous, 4 duplicated appeals were terminated in the prescribed manner, 1 appeal was taken into account, 299 appeals were sent to the relevant ministries and departments under their jurisdiction.

Of the appeals received, 488 were received from individuals, 67 from legal entities, 401 appeals were in writing, 92 in electronic form, 62 in oral form, of which 37 appeals were received during a personal reception of the Agency’s Director, 21 appeal were accepted by the responsible officers of the Agency and 4 appeals through call center. 

Based on the results of consideration of appeals, 38 enquiries were sent to the relevant ministries and departments, regional (district, city) administrations, 6 statutory notices were sent to eliminate violations.

Based on the results of consideration of appeals, one document issued in violation of the law was annulled, according to the documents provided by the Agency, law enforcement agencies initiated four criminal cases and one case of disciplinary liability, and measures were taken to eliminate existing shortcomings. The amount of financial errors and omissions identified in the study of appeals amounted to 30.3 billion soums.

Most of the appeals received by the Agency relate to problems in the judicial and legal sector, the misconduct of officials and corruption in various areas.

As a result of large-scale reforms in the country and the practical work carried out by the Anti-Corruption Agency, including the implementation of anti-corruption projects in various areas and roadmaps to prevent corruption, as well as inctroducing amendments to legislation, there is a decrease in the number of appeals received by the Agency, also in the context of industries.

In particular, compared to 1,543 appeals received by the Agency in the first quarter of 2021 and 555 appeals in the first quarter of 2022, the number of appeals in percentage terms decreased by 64%.

In the context of industries, the number of appeals in some areas has sharply decreased:

  • problems with granting of pensions and social benefits by 83.3%;

  • violations of labor legislation by 82.6%;

  • theft of budgetary funds by 80.0%;

  • disagreement with court decisions in civil cases by 78.2%;

  • problems with power supply by 75.0%;

  • in the field of cadastre by 73.7%;

  • problems in housing and communal services by 73.3%;

  • in the field of public education by 72.1%;

  • cases of violations in the field of healthcare and the misconduct of medical personnel by 72.1%;

  • disagreement with the decisions of courts in criminal cases by 68.3%;

  • disagreement with the the Compulsory Enforcement Bureau decisions by 66.7%.

Also, compared to the first quarter of 2021, in the first quarter of 2022, there were no appeals in some areas and fields. In particular, in the first quarter of this year, there were no appeals on religion, ecology, obtaining a passport, or drinking water supply.

At the same time, in 2022, there is an increase in the number of appeals in certain areas compared to the first quarter of 2021. In particular:

  • 1200 % increase in disagreement with the actions of employees of public administration bodies (in the first quarter of 2021 - 1 appeal, in the first quarter of 2022 - 13 appeals);

  • 325 % increase in issues of protecting the interests of business entities (in the first quarter of 2021 - 4 appeals, in the first quarter of 2022 - 17 appeals);

  • 100 % increase in insurance issues (in the first quarter of 2021 - 0 appeal, in the first quarter of 2022 - 1 appeal);

  • 80 % increase in disagreement with decisions of economic courts (in the first quarter of 2021 - 5 appeals, in the first quarter of 2022 - 9 appeals);

  • 46.2 % increase in issues of recovery of compensation for damage from natural disasters (in the first quarter of 2021 - 13 appeals, in the first quarter of 2022 - 19 appeals);

  • 10 % increase in preschool education issues (in the first quarter of 2021 - 10 appeals, in the first quarter of 2022 - 11 appeals).

In the first quarter of 2022, the Anti-Corruption Agency received appeals from different regions of the country in the following order:

Tashkent city - 159;

Tashkent Region - 51;

Namangan Region - 45;

Sirdarya Region - 41;

Kashkadarya Region - 35;

Navoi Region - 32;

Samarkand Region - 31;

Surkhandarya Region - 29;

Andijan Region - 26;

Ferghana Region - 25;

Bukhara Region - 21;

Jizzakh Region - 20;

Khorezm Region - 19

Republic of Karakalpakstan - 19;

Appeals received from abroad - 2.

Compared with the first quarter of 2021, this year the number of appeals to the Agency from the regions decreased in the following order - from Surkhandarya Region by 80.8%, from Samarkand Region by 78.0%, from Khorezm Region by 75.9%, from Jizzakh Region75.9%, from Kashkadarya Region 74.5% and from Bukhara Region by 66.7%.

Considering the importance of fighting corruption, eliminating the factors that give rise to corruption, finding ways to solve problems, developing proposals for further improving legislation based on the analysis of appeals and identifying appropriate measures, the Anti-Corruption Agency approved the relevant Action Plan 2022.

According to this Plan, in 2022 it is planned to develop and submit to the relevant authorities draft regulatory legal acts on amendments and additions to the current legislation. In order to ensure the implementation of these tasks in the first quarter of this year, the Agency studied the relevant draft law on amendments and additions to the Criminal and Criminal Procedure Codes of the Republic of Uzbekistan as well as the practice of imposing certain types of punishment on persons convicted of corruption offenses, based which an appropriate draft law has been prepared.
