Liability for Corruption Offenses Is Being Strengthened

At today’s plenary session of the Legislative Chamber of the Oliy Majlis, a draft law aimed at enhancing the effectiveness of anti-corruption efforts and ensuring the inevitability of liability for corruption offenses was adopted in the second reading.

The draft law introduces amendments and additions to 3 codes and 5 laws. In particular:

▫️it provides for the establishment of an electronic register of persons convicted of corruption-related crimes;

▫️the Criminal Code introduces a definition of “corruption-related crimes”, which will include 18 types of criminal offenses;

▫️penalties are being strengthened for crimes such as embezzlement or misappropriation, as well as fraud, when committed through the abuse of official authority;

▫️it is stipulated that, for certain corruption-related crimes, provisions on parole or the replacement of punishment with a lighter sentence shall not apply;

▫️the powers, rights, and obligations of compliance and internal anti-corruption control structures are being established by law;

▫️administrative liability is being introduced for violating the permissible difference (an average of 20 percent) between the initial price of goods (services) and the average market price in public procurement procedures;

▫️the Law “On Public Procurement” will also establish the obligation of state customers to comply with the установленный limit on price differences;

▫️the Anti-Corruption Agency is being tasked with developing a corruption risk map for every state body and organization, as well as by regions and sectors;

▫️the status and functions of the National Anti-Corruption Council and territorial councils are being defined, while the Anti-Corruption Agency is being assigned 8 new responsibilities.

In addition, the legislation introduces provisions aimed at fostering among young people a sense of integrity and an intolerant attitude toward corruption, as well as ensuring consideration of the main directions of state policy on combating corruption in the fields of education and upbringing.
